Welcome to MYLUXE, your premier destination for secondhand luxury designer bags and accessories. By using our website and services, you agree to the following Terms and Conditions (the “T&C”). If you do not agree with these T&C, please do not use our services.

 


 

1. Introduction


MYLUXE ("we," "us," or "our") operates an online marketplace where customers can purchase authenticated secondhand luxury items, including designer handbags and accessories. These T&C govern your use of our website and services, including but not limited to browsing, purchasing, and using any other services we offer.



 

2. General Terms

  • Eligibility: You must be at least 18 years of age to access or use our website.

  • Acceptance: By using our services, you acknowledge and agree to these T&C, which may be updated periodically without prior notice.

  • Modifications: We reserve the right to update or change these T&C at our sole discretion. Changes will be posted on this page, and it’s your responsibility to review these T&C periodically for updates.



 

3. Products and Pricing

  • Product Information: MYLUXE offers only authenticated secondhand luxury goods. All product descriptions, including images and specifications, are provided to give you a clear representation of the items.

  • Prices: All prices are listed in AED (United Arab Emirates Dirhams) unless specified otherwise. Prices are inclusive of VAT for UAE-based customers.

  • VAT: In line with UAE regulations, VAT is applied at the prevailing rate of 5% to all items purchased by customers within the UAE. For international orders, applicable taxes and duties will be calculated and charged at checkout.

  •  Price Reduction
    From time to time, MYLUXE may run promotions or issue vouchers. MYLUXE reserves the right to reduce the price of an item by deducting from its commission without prior notice to the seller. Sellers may also perform price reductions after listing an item without notifying MYLUXE.



 

4. Payment Methods

We offer several secure payment methods:

  • Credit Cards: Visa, MasterCard, American Express.

  • Digital Wallets: Apple Pay, Google Pay.

  • Payment Installments: Buy Now, Pay Later options via third-party providers like Tamara.

  • Cash on Delivery (COD): Available only for customers within the UAE.

Payment must be completed in full before shipping, unless otherwise agreed upon.



 

5. Order Processing and Shipping

  • Processing Time: Orders are typically processed within 1-2 business days. You will receive an email confirmation with tracking information once your order has been shipped.

  • Shipping Fees: Shipping charges will be added at checkout, depending on the delivery address and service selected.

  • Delivery Time: Delivery times will vary based on location. Orders within the UAE are typically delivered within 2-5 business days, while international orders may take longer, depending on customs and other factors.

  • International Shipments: International orders may incur additional shipping charges, customs duties, or taxes, which are the responsibility of the customer.



 

6. Returns and Refunds

We offer a flexible return policy to ensure your satisfaction:

  • Returns: If you change your mind, you may return your item within 3 days of delivery. The item must be unused, in original condition, and with the original packaging.

  • Authenticity Issues: If the item is found to be inauthentic, we will provide a full refund, including return shipping.

  • Refund Process: Refunds will be processed to the original payment method and may take 7-10 business days, depending on the payment provider.

Please note that items purchased with promotional discounts or on sale may not be eligible for returns or refunds unless otherwise specified.



 

7. Delivery

MYLUXE may be unable to successfully deliver items due to discrepancies between live inventory listings and partner stock. In such cases, MYLUXE reserves the right to cancel orders for unavailable items and issue a full refund if payment has already been made. The placement of an order does not guarantee the successful delivery of the item. MYLUXE is not responsible for any delays caused by customs clearance at the destination. Furthermore, MYLUXE will not handle or provide services or products to any countries sanctioned by the UAE, as per the relevant laws. 8. Authentication Guarantee


MYLUXE guarantees the authenticity of all items sold. Each item undergoes a thorough 3-layer authentication process to ensure it meets our stringent quality standards. If an item is found to be inauthentic after purchase, we will cancel the transaction and issue a full refund.




 

9. Sellers Commission Fee Structure


Listing your items is free on our platform. However, a commission and operation fee will apply upon the sale of an item. The following structure outlines the applicable fees:


1. Commission Rates:

  • First 8000 AED of the item value: 25% commission
  • Above 8000 AED of the item value: 10% commission


2. Operation fixed fee:

A fixed fee of 100 AED  per item is applied to cover operational costs such as authentication and listing.

Example Calculation:

For an item valued at 20 000 AED, the commission and fees are calculated as follows:

Notes:

  • Commission is non-negotiable and applies to all sellers.
  • The fixed operation fee is deducted in addition to the commission.

 

For items of a value below 8000 AED, a fixed commission of 800 AED is applied. 



 

10. Sellers terms


By agreeing to sell on MYLUXE, the Seller agrees to pay the commission applicable to the sale of their item(s). Sellers agree that their items will be made available for sale, and customers can place orders at any time. The following terms apply:

  • All sales are final; sellers cannot modify the selling price once an item has been ordered.

  • Sellers are responsible for actively managing their inventory and should promptly unlist or delete items that are no longer available for sale or that they no longer wish to sell.

  • Failure to fulfill an order after it has been placed may negatively affect the seller's store reputation and visibility. Consistent failure to fulfill orders may result in permanent account suspension.

  • MYLUXE reserves the right to request additional information from any bulk or other sellers.

  • Sellers will receive payment via bank transfer only. Any additional charges imposed by banks or intermediary banks will be borne by the seller.



 

11. Buyer Terms


This section forms a binding agreement between the Buyer and MYLUXE. The Buyer acknowledges that MYLUXE is not affiliated with the brands sold on the platform. The Buyer agrees to the following terms when purchasing an item:

  • Authentication: MYLUXE's authentication process is independent and not affiliated with any brand owners.

  • Item Descriptions: Descriptions are not warranties, and all items are sold "as is."

  • Cancellation: If a Buyer wishes to cancel an installment order, they must contact MYLUXE.

  • Inaccurate Description: If the Buyer receives an item that has been inaccurately described or misrepresented, a claim must be made within 3 days of receiving the item. A full refund will be provided if the claim is validated.

  • Item Rejection: MYLUXE reserves the right to reject items with unclear or misleading images or descriptions that do not match the actual item.



 

12. Buyer Shipping Fees


Shipping costs are calculated based on the final destination or nearest authentication center. The Buyer shall bear all duties, taxes, and customs fees, which may vary depending on the item type and destination country.



 

13. Account Security and Responsibility

  • Account Creation: You may be required to create an account to make purchases or use certain services. By doing so, you agree to provide accurate and complete information.

  • Security: You are responsible for maintaining the confidentiality of your account information and password. MYLUXE is not liable for any unauthorized use of your account.

  • Third-Party Services: Our website may contain links to third-party sites or services that are not under our control. MYLUXE does not endorse or assume responsibility for the content, privacy policies, or practices of third-party websites.



 

14. Limitation of Liability


MYLUXE will not be held responsible for any indirect, incidental, or consequential damages arising from the use of our website, products, or services. Our total liability will not exceed the amount paid for the products or services in question.




 

15. Loss and Damages


MYLUXE will maintain appropriate insurance coverage for consigned items, protecting against risks such as fire, flood, theft, and damage. However, the Buyer assumes all risk for loss or damage to the item during return transit until it is delivered back to MYLUXE. If the condition of the item is re-assessed and found to be in worse condition than initially described, MYLUXE reserves the right to adjust the payout amount accordingly.

 


 

16. Partnerships and Associations

Third-party associates, bloggers, influencers, social media celebrities, and any other individuals or entities involved in media promotions are collectively referred to as "Partners."

MYLUXE welcomes a variety of partnerships with bloggers, influencers, and other media personalities for promotional activities. MYLUXE retains the right to continue or discontinue any partnership at its sole discretion.

Please note that MYLUXE is not liable for any costs associated with events, activities, or promotions conducted by partners, bloggers, or influencers. These partnerships are strictly for promotional purposes, and MYLUXE is under no obligation to provide financial compensation for any activities undertaken by such individuals or groups.

Items loaned to partners, influencers, or bloggers for promotional purposes must be returned to MYLUXE within 7 days from the loan date. The items must be returned in their original condition, including all packaging and tags. If the items are returned damaged or with missing packaging/tags, the partner, influencer, or blogger will be required to pay the full price of the item as a damage fee. MYLUXE reserves the right to determine the damage fee in such cases and negotiate a fair amount.

When partners mention MYLUXE on social media, they are required to give full credit to the brand. Social media tags and mentions must be visible, exclusive, and accompanied by a mandatory caption that includes the tag @MYLUXE. The mentions should be prominent to ensure MYLUXE’s visibility and exclusivity in the post.

MYLUXE also reserves the right to conduct social media competitions and giveaways from time to time. Winners of these competitions will be randomly selected. MYLUXE is not obliged to disclose the details of participants in these competitions.

Buyers may redeem only one promotion, coupon, or voucher code per transaction. MYLUXE reserves the right to withdraw any promotional coupon codes at any time without prior notice.



 

17. Intellectual Property

  • Ownership: All content, logos, trademarks, and other materials on the MYLUXE website are owned or licensed by MYLUXE and are protected by copyright and trademark laws.

  • Use of Content: You may not copy, modify, distribute, or reproduce any content from our website without express written permission.



 

18. Privacy and Data Protection

We respect your privacy and are committed to protecting your personal information. For more details on how we collect, store, and protect your data, please refer to our Privacy Policy.



 

19. Governing Law

  • Jurisdiction: These T&C are governed by and construed in accordance with the laws of the United Arab Emirates.

  • Dispute Resolution: Any dispute related to these T&C or your use of our services will be resolved through arbitration in Dubai, UAE.



 

20. Termination of use

We reserve the right to suspend or terminate your access to our website or services at any time, for any reason, including breach of these T&C. Upon termination, all rights granted to you under these T&C will cease immediately.
